Terms of Use

Please read these terms carefully before using BookSansar. By using our platform, you agree to be bound by these terms.

Summary

These terms govern your use of BookSansar as a buyer, seller, swapper, or visitor. Key points: you must be 13+ to use the platform (18+ to become a rider); payments are via eSewa and Khalti only — no cash on delivery; BookSansar charges a 3% commission on sales; and all transactions are subject to our Return & Refund Policy. Nepal law applies.

1. Acceptance of Terms

By accessing or using BookSansar (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our platform. BookSansar reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

2. Eligibility

You must be at least 13 years of age to use BookSansar. By using the platform, you represent and warrant that you meet this age requirement. Users under 18 should use the platform under parental or guardian supervision. To apply as a BookSansar delivery rider, you must be at least 18 years old and hold a valid driving license. BookSansar reserves the right to terminate accounts of users found to be in violation of these requirements.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. Your registered email address is permanent and cannot be changed after account creation. BookSansar reserves the right to suspend or terminate accounts that contain false information, violate these terms, or engage in suspicious activity. You must notify us immediately of any unauthorized use of your account.

4. Buying Books

When you place an order on BookSansar, you are making an offer to purchase. Orders are confirmed only after payment is successfully processed. Prices are listed in Nepali Rupees (NPR). BookSansar accepts payments via eSewa and Khalti only. Cash on delivery is not available. For physical and second-hand books, your payment is held in escrow by BookSansar until the book is delivered, at which point the funds are released to the seller. BookSansar reserves the right to cancel orders due to pricing errors, stock unavailability, or suspected fraudulent activity and will issue a full refund in such cases. Physical book descriptions are provided by sellers and BookSansar makes reasonable efforts to verify accuracy.

5. Selling on BookSansar

Sellers must register as a vendor and be approved before listing books for sale. By listing a book, sellers confirm they have the legal right to sell it. Sellers are responsible for accurate descriptions, correct pricing, and timely fulfillment of orders. BookSansar charges a 3% platform commission on each completed sale, which is automatically deducted through the escrow system before funds are released to the seller. Listing a book is free. Selling counterfeit, unauthorized, or prohibited content is strictly banned and may result in permanent account suspension and legal action. BookSansar reserves the right to remove listings at any time without prior notice.

6. Book Swap

BookSansar provides a Book Swap feature that allows registered users to exchange physical books with other users at no cost. By posting a swap listing, you confirm that you own the book and are willing to exchange it in person. No payment is processed through BookSansar for swap transactions — all exchanges are arranged directly between users via the platform's built-in chat and carried out in person. BookSansar is not responsible for disputes, losses, or damages arising from book swap exchanges. Users must not misrepresent the condition of books listed for swap. Swap listings must be marked as completed once the exchange has taken place. BookSansar reserves the right to remove swap listings that violate community guidelines.

7. User Content & Free Books

Users who contribute free notes, books, or other digital content to BookSansar grant us a non-exclusive, royalty-free license to display and distribute that content on the platform. You retain ownership of your content. All submissions are reviewed by our team before being published. You must not upload content that is plagiarized, copyrighted without permission, offensive, misleading, or harmful. Free digital books and notes on BookSansar are provided for personal, non-commercial reading and educational use only. BookSansar may remove content that violates these guidelines without prior notice.

8. Prohibited Activities

Users are prohibited from: using the platform for any unlawful purpose; scraping, crawling, or data mining the platform without permission; attempting to gain unauthorized access to any part of the platform; uploading viruses or malicious code; impersonating another person or entity; manipulating ratings or reviews; misrepresenting book conditions in swap or sale listings; reselling books purchased at discounted rates in bulk for commercial gain without seller status; and engaging in any activity that disrupts normal platform operations.

9. Intellectual Property

All content on BookSansar — including logos, graphics, UI design, and platform code — is the intellectual property of BookSansar and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission. BookSansar respects the intellectual property rights of others and expects users to do the same.

10. Privacy

Your use of BookSansar is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data as described in our Privacy Policy. By using the platform, you consent to the collection and use of your data as outlined therein. BookSansar will never sell your personal data to third parties.

11. Disclaimers & Limitation of Liability

BookSansar provides the platform "as is" and makes no warranties regarding its availability, accuracy, or fitness for a particular purpose. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our maximum liability to you for any claim shall not exceed the amount you paid for the transaction giving rise to the claim. BookSansar is a marketplace and is not responsible for disputes between buyers and sellers beyond what is covered in our Return & Refund Policy.

12. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these terms or your use of BookSansar shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
